Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Hauser website, platform, and services (collectively, the "Services") provided by Hauser OS Inc. ("Hauser," "we," "our," or "us"). By accessing or using the Services, you agree to these Terms.

Hauser provides technology-enabled buyer representation services through Avenida Real Estate Inc., a licensed California real estate brokerage (CA DRE #02247189). Both Hauser OS Inc. and Avenida Real Estate Inc. are wholly owned subsidiaries of Thoughtful Holdings Inc.

1. Our Services

Hauser provides flat-fee buyer representation services in the San Francisco Bay Area, including:

  • Property due diligence and disclosure analysis

  • Proprietary property intelligence and scoring

  • Offer strategy and negotiation

  • Full buyer representation through closing

  • Post-purchase property intelligence

We exclusively represent buyers. We do not represent sellers. We do not engage in dual agency.

2. Eligibility

You must be at least 18 years old and legally capable of entering into contracts to use our Services.

3. Account Registration

If you create an account:

  • You are responsible for maintaining the confidentiality of your credentials

  • You agree to provide accurate and complete information

  • You are responsible for all activity under your account

We reserve the right to terminate accounts for violations of these Terms.

4. Prohibited Activities

You agree not to:

  • Use the Services for unlawful purposes

  • Interfere with the security or proper functioning of our platform

  • Copy, modify, or distribute our content without permission

  • Reverse engineer or attempt to extract our proprietary systems

  • Use automated systems to access the Services without permission

  • Upload malicious code or content

5. Buyer Representation Agreement

Engagement of our buyer representation services requires execution of a separate Buyer Representation Agreement governing scope, term, fees, and termination. These Terms supplement but do not replace that agreement. In the event of conflict, the Buyer Representation Agreement controls.

6. Fees and Payment

Flat Fee Model. Hauser charges a flat fee for buyer representation. Current pricing is displayed on our website. Fees are not based on purchase price.

Payment Terms. As specified in your Buyer Representation Agreement.

Refund Policy. Governed by your Buyer Representation Agreement. Fees for services rendered are generally non-refundable.

7. Platform and Property Intelligence

Platform Access. Provided as part of buyer representation services.

Data Sources. Our platform aggregates data from multiple third-party sources, including MLS data, inspection reports, public records, permit databases, environmental data, and other providers. We do not independently verify third-party data. Information is provided as received.

Informational Purposes Only. All property intelligence, scoring, analysis, and recommendations are for informational and educational purposes only. Our analysis is designed to assist your decision-making—not replace it.

No Professional Advice. Our platform does not provide legal, financial, tax, appraisal, inspection, insurance, or any other professional advice. Consult qualified professionals for advice in these areas.

No Warranties. Property intelligence is provided "as is" without warranties of accuracy, completeness, or reliability. We do not guarantee the condition of any property or the accuracy of any third-party data.

Independent Verification Required. You are responsible for independently verifying all information material to your purchase decision.

Point-in-Time. Analysis reflects data available at time of processing and is not continuously updated.

Post-Closing Access. Property intelligence transitions to our owner platform after closing.

8. Intellectual Property

Our Content. All content on our website and platform—including text, graphics, logos, software, methodology, and scoring systems—is owned by or licensed to Hauser OS Inc. and protected by intellectual property laws.

Limited License. You receive a limited, non-exclusive, non-transferable license to access and use the Services for personal home-buying purposes. You may not reproduce, distribute, or create derivative works, or use our methodology for commercial purposes.

Your Content. You retain ownership of documents you upload. By uploading, you grant us a license to use, process, and analyze such materials to provide our Services.

9. Disclaimers

"As Is" Basis. The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Real Estate Disclaimers. We are not providing legal, tax, financial, or investment advice. Property information should be independently verified. Real estate transactions involve inherent risks. Past performance of properties or markets does not predict future results.

Data Disclaimers. We aggregate data from third-party sources and do not independently verify its accuracy. Third-party data is provided as received. We are not responsible for errors, omissions, or inaccuracies in third-party data.

Technology Disclaimers. We do not guarantee uninterrupted or error-free access. Analysis reflects data available at time of processing. Technology tools supplement, not replace, professional judgment and independent verification.

10. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or punitive damages

  • Our total liability shall not exceed fees you paid in the twelve months preceding the claim

11. Indemnification

You agree to indemnify and hold Hauser, Avenida Real Estate Inc., Thoughtful Holdings Inc., and their respective officers, directors, employees, and agents harmless from claims arising out of your use of the Services or violation of these Terms.

12. Termination

By You. Terminate your account by contacting us. Does not affect obligations under any Buyer Representation Agreement.

By Us. We may suspend or terminate access for violations of these Terms or at our discretion.

13. Dispute Resolution

Governing Law. California law, without regard to conflict of law provisions.

Arbitration. Disputes shall be resolved by binding arbitration in San Diego County, California, under JAMS rules. You waive class action rights.

Exceptions. Either party may seek injunctive relief for intellectual property violations.

14. Changes to Terms

We may update these Terms at any time. Changes are effective upon posting. Material changes will be communicated via email or platform notification.
