About These Terms
These Terms of Service ("Terms") govern your access to and use of the Hauser platform, website, tools, and related technology services (collectively, the "Platform") operated by Hauser OS Inc. ("Hauser OS," "we," "our," or "us").
Hauser OS Inc. is a technology company. It develops and operates the Platform, including proprietary property intelligence software, scoring systems, data tools, and AI-assisted features. Hauser OS Inc. does not hold a California real estate license and does not provide real estate brokerage services.
Real estate brokerage services are provided separately by Avenida Real Estate Inc. (CA DRE #02247189), a licensed California brokerage that operates under the registered trade name "Hauser" as a DBA. Hauser OS Inc. and Avenida Real Estate Inc. are both wholly owned subsidiaries of Thoughtful Holdings Inc.
The use of the "Hauser" name across both entities reflects a unified consumer brand. However, your legal relationship with each entity is distinct:
Your relationship with Hauser OS Inc. is governed by these Terms.
Your relationship with Avenida Real Estate Inc. dba Hauser is governed by a separate Buyer Representation Agreement executed under California real estate law, including applicable CAR forms.
By accessing or using the Platform, you agree to these Terms and acknowledge our Privacy Policy, available at hauserhq.com/legal/privacy-policy. If you do not agree, do not use the Platform.
1. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use the Platform. By using the Platform, you represent that you meet these requirements.
2. Account Registration
To access certain features, you may be required to create an account. You agree to:
Provide accurate, current, and complete information
Maintain the confidentiality of your credentials
Take responsibility for all activity that occurs under your account
Notify us immediately of any unauthorized access or suspected breach
Hauser currently supports account creation via Google sign-in. If you choose to create or access your account using Google, your use of that authentication is also subject to Google’s terms and privacy policies, and you authorize Hauser to receive basic profile information (such as your name and email) from Google to create and maintain your account. We may add or change supported authentication providers in the future.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Platform or other users.
3. The Platform — What Hauser OS Provides
Hauser OS Inc. operates a technology platform that provides:
Property intelligence and scoring via the HauserEQ system, including ConditionScore and ContextScore
Analysis of inspection reports, disclosure documents, permit records, and other property materials uploaded by you or obtained from third-party data sources
AI-assisted features, including document parsing, property summaries, and educational decision-support tools (collectively, "AI Features")
Financial tools including mortgage, affordability, refinance, HELOC, rent vs. buy, and closing cost calculators
A homeowner intelligence dashboard for post-purchase property tracking and planning
Informational Purposes Only
All Platform outputs — including property scores, analyses, AI-generated content, and financial calculations — are for informational and educational purposes only. They are not appraisals, inspections, legal advice, financial advice, tax advice, or professional opinions of any kind.
Platform outputs are designed to assist your decision-making. They do not replace independent professional advice or your own judgment.
AI Features
Certain Platform features use large language models and machine learning to generate content, summaries, or recommendations. You acknowledge that:
AI-generated outputs may be incomplete, inaccurate, or outdated
AI outputs are not a substitute for professional real estate, legal, financial, or inspection advice
You should independently verify any AI-generated content before relying on it
Third-Party Data
The Platform aggregates data from multiple third-party providers, including property data APIs, public records, MLS feeds, permit databases, satellite and environmental data sources, and listing photo analysis. Hauser OS Inc. does not independently verify third-party data and provides it as received. We are not responsible for errors, omissions, or inaccuracies in third-party data.
Computer Vision and Listing Photo Analysis
The Platform includes features that analyze MLS listing photographs using computer vision to identify materials, finishes, and property characteristics. This analysis is automated and interpretive. Results reflect visual inference only and do not constitute a physical inspection or professional assessment of the property.
Point-in-Time
All Platform outputs reflect data available at the time of processing. Property conditions, market data, and third-party information change over time. The Platform does not provide continuous or real-time updates unless expressly stated.
Feature Availability by Tier
Specific features available to you depend on your subscription tier. Current tiers, included features, and pricing are described at hauserhq.com/pricing. See Section 6 for billing and subscription terms.
4. Real Estate Services — Avenida Real Estate Inc. dba Hauser
If you engage buyer representation services through the Hauser brand, those services are provided by Avenida Real Estate Inc. (CA DRE #02247189), operating as "Hauser" pursuant to a registered DBA.
Avenida Real Estate Inc. exclusively represents buyers. It does not represent sellers and does not engage in dual agency.
Engagement of buyer representation services requires execution of a separate Buyer Representation Agreement ("BRA") with Avenida Real Estate Inc. The BRA, including any applicable CAR forms and flat-fee addenda, governs the brokerage relationship in its entirety. These Terms do not govern and expressly disclaim application to the brokerage relationship. In the event of any conflict between these Terms and the BRA with respect to brokerage services, the BRA controls.
Flat-Fee Model
Avenida Real Estate Inc. dba Hauser charges a flat fee for buyer representation services, as set forth in your Buyer Representation Agreement. Fees are not calculated as a percentage of purchase price. Current fee schedules are displayed at hauserhq.com/pricing.
Service Availability
Real estate brokerage services are available only in jurisdictions where Avenida Real Estate Inc. is licensed and operationally able to serve clients. Avenida is currently licensed in California. Service availability in additional states will be reflected on hauserhq.com as new markets are added. Hauser OS Inc.’s technology platform may be accessible to users outside Avenida’s service areas, but no brokerage relationship is created or implied by such access.
5. Contractor Directory and Third-Party Service Providers
The Platform may include a directory feature that allows you to identify, save, and organize home-related contractors and service providers ("Service Providers"), including general contractors, electricians, plumbers, landscapers, cleaners, and similar professionals.
Sources of Listings
Listings in the directory may be drawn from publicly available business information, including data sourced from Google Business listings and similar third-party providers. You may also manually add Service Providers of your own choosing to your personal directory within your account.
Hauser Is a Directory, Not a Vetting Service
Hauser OS Inc. provides the directory as a convenience to help you locate and organize Service Providers. Hauser OS Inc. does not vet, verify, screen, or otherwise evaluate any Service Provider listed in or added to the directory. We do not verify licenses, insurance, certifications, qualifications, work quality, pricing, business practices, or fitness for any particular purpose.
No Endorsement
Inclusion of a Service Provider in the directory is not a recommendation or endorsement by Hauser OS Inc. We do not select, rank, or curate Service Providers based on our own assessment of their suitability.
No Compensation from Service Providers
Hauser OS Inc. does not receive payment, commission, referral fees, kickbacks, or any other form of compensation from Service Providers in exchange for inclusion in the directory or for being selected by users. The directory is offered as a feature of the Platform, not as a lead-generation product.
Your Responsibility
You are solely responsible for evaluating any Service Provider before engaging them. This includes verifying applicable professional licenses, confirming insurance coverage, checking references and reviews, reviewing and negotiating contracts, and confirming pricing. Any agreement, communication, payment, or work performed between you and a Service Provider is solely between you and that Service Provider.
Information Accuracy
Directory information — including business names, contact details, hours, services offered, and ratings — is sourced from third-party providers and is provided as received. Hauser OS Inc. does not guarantee that directory information is current, accurate, or complete.
No Liability for Service Provider Conduct
Hauser OS Inc. is not responsible and assumes no liability for the conduct, work product, communications, pricing, performance, omissions, or any other actions or inactions of any Service Provider. We are not a party to any agreement between you and a Service Provider. Any disputes arising from your engagement with a Service Provider are between you and the Service Provider, and you agree not to seek to hold Hauser OS Inc. responsible for the resolution or outcome of such disputes.
6. Fees and Payment — Platform Services
Access to certain Platform features requires payment of subscription or usage fees. Current pricing and tier descriptions are available at hauserhq.com/pricing. By subscribing or purchasing access, you authorize Hauser OS Inc. and our payment processor to charge the applicable fees to your designated payment method.
All fees are stated in U.S. dollars. Fees are non-refundable except as required by law or as expressly stated at the time of purchase.
Billing Cycle
Subscription fees are billed in advance at the start of each billing period — monthly or annually, depending on the plan you select. The first payment is charged on the date you start your subscription; subsequent payments are charged on the same calendar day of each subsequent billing period.
Automatic Renewal
Before you complete any subscription purchase, we will present the recurring price, billing frequency, renewal terms, cancellation method, and any trial-to-paid conversion terms in a clear and conspicuous manner. By subscribing, you affirmatively consent to the automatic renewal terms presented at checkout.
Your subscription automatically renews at the end of each billing period for an additional period of the same length, at the then-current price for your tier, unless you cancel before the renewal date. By subscribing, you authorize Hauser OS Inc. to charge your designated payment method for each renewal until you cancel.
Cancellation
You can cancel your subscription at any time. If you subscribed online, you may cancel online through your account settings without being required to call, email, or interact with a live representative. You may also cancel by contacting legal@hauserhq.com. Cancellation takes effect at the end of your current billing period. You will retain access to subscription features until that date, after which access will end and no further charges will be made. Cancellation of a subscription does not entitle you to a refund of any portion of fees paid for the current billing period.
Changes to Pricing
Hauser OS Inc. reserves the right to modify pricing for any subscription tier at its discretion. If we change the price of a tier you are subscribed to, we will provide notice via email to the address associated with your account at least 30 days before the change takes effect. The new price will apply to your next billing cycle following the notice period. If you do not agree to the new pricing, you may cancel your subscription before the change takes effect, and the new price will not be charged.
Failed Payments
If a payment fails or is declined, we may attempt to charge your payment method again, suspend your access to subscription features until payment is received, or terminate your subscription. You are responsible for keeping your payment method information current.
Changing Your Subscription
You can upgrade or downgrade your subscription tier at any time through your account settings. Upgrades take effect immediately, and you will be charged a prorated amount for the upgraded tier for the remainder of your current billing period. Downgrades take effect at the end of your current billing period; you retain access to your current tier until then. No partial refunds are issued for downgrades.
Taxes
Stated prices do not include applicable sales, use, or similar taxes. Where Hauser OS Inc. is required to collect such taxes, they will be added to the amount charged.
7. Prohibited Activities
You agree not to:
Use the Platform for any unlawful purpose or in violation of applicable law
Reverse engineer, decompile, or attempt to extract proprietary algorithms, scoring methodologies, or source code
Reproduce, distribute, sell, sublicense, or create derivative works from Platform content or outputs without our written consent
Use automated systems, bots, scrapers, or data extraction tools to access the Platform without authorization
Upload files containing malware, viruses, scripts, macros, corrupted payloads, or any other content designed to disrupt, damage, access, or interfere with the Platform or any third-party system
Misrepresent your identity, credentials, or relationship to any property
Resell or commercially exploit Platform outputs or data without a separate written agreement
8. Intellectual Property
Our IP
All content, software, methodology, scoring systems, algorithms, trade names, trademarks, and other intellectual property on or accessible through the Platform — including HauserEQ, ConditionScore, ContextScore, HMI, and associated documentation — are owned by or licensed to Hauser OS Inc. and are protected by applicable intellectual property laws. Patent pending.
The name "Hauser" and the Hauser logo are trademarks of Hauser OS Inc. The use of "Hauser" as a trade name by Avenida Real Estate Inc. is authorized pursuant to a registered DBA and does not constitute an assignment or license of trademark rights to any third party.
Limited License to You
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your personal, non-commercial home-buying or homeownership purposes. This license does not include the right to reproduce, modify, distribute, or commercially exploit any portion of the Platform.
Your Content
You retain ownership of documents and materials you upload to the Platform ("Uploaded Content"). By uploading or otherwise providing Uploaded Content to Hauser, you grant Hauser OS Inc. a limited license to process, analyze, and use such materials to provide Platform services to you and to maintain and improve the Platform. We do not claim ownership of your Uploaded Content and will not share it with third parties except as set forth in our Privacy Policy.
You represent and warrant that you have the right to provide any Uploaded Content to Hauser, including documents authored by third parties such as home inspection reports, appraisals, disclosure packages, warranty documents, repair invoices, and similar materials. You agree to indemnify Hauser OS Inc. against any claims arising from your provision of Uploaded Content that you did not have the right to share.
Use of Uploaded Content for Platform Improvement
Hauser OS Inc. may use de-identified, aggregated content derived from Uploaded Content to improve the Platform, refine scoring methodology, and develop new features. This may, in the future, include training, fine-tuning, and improving Hauser’s own AI features. We do not provide raw Uploaded Content to any third party for the purpose of training third-party foundation models or other third-party AI systems. We will not use Uploaded Content in ways that personally identify you, and we do not sell Uploaded Content.
Hauser-Derived Works
Hauser OS Inc. owns the scoring methodology, analytical framework, models, templates, and generated output formats used by the Platform, including ConditionScores, ContextScores, repair burden assessments, AI-generated summaries, and similar derivative works ("Hauser-Derived Works"). You may use the Hauser-Derived Works made available in your account for your personal home-buying or homeownership purposes, subject to these Terms. The underlying scoring and analytical methodology, however, remains the intellectual property of Hauser OS Inc.
9. Disclaimers
The Platform and all outputs are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. Without limiting the foregoing:
We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components
We do not warrant the accuracy, completeness, or reliability of any data, score, analysis, or AI-generated output
We are not responsible for real estate transaction outcomes, property conditions, market changes, or decisions made in reliance on Platform outputs
Third-party data is provided as received; we are not responsible for third-party errors or omissions
Nothing in these Terms limits liability that cannot be excluded under applicable California or federal law.
10. Limitation of Liability
To the maximum extent permitted by law, Hauser OS Inc., its officers, directors, employees, and agents shall not be liable for:
Indirect, incidental, special, consequential, exemplary, or punitive damages of any kind
Loss of profits, revenue, data, goodwill, or business opportunity
Damages arising from reliance on Platform outputs, third-party data, or AI-generated content
Damages arising from real estate transactions, property conditions, or market outcomes
Our total aggregate liability to you for any claims arising under or related to these Terms shall not exceed the greater of (a) fees paid by you to Hauser OS Inc. in the twelve months preceding the claim, or (b) one hundred dollars ($100).
These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
11. Indemnification
You agree to indemnify, defend, and hold harmless Hauser OS Inc., Avenida Real Estate Inc., Thoughtful Holdings Inc., and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
Your use of or access to the Platform
Your violation of these Terms
Your violation of any applicable law or third-party right
Any content you upload to the Platform
12. Service Modifications and Availability
Hauser OS Inc. is a technology company that continuously evolves the Platform. We reserve the right to modify, add, remove, suspend, or discontinue any feature, tool, scoring methodology, integration, or component of the Platform at any time, with or without notice. We will use commercially reasonable efforts to notify users of material changes that significantly affect functionality or access.
The Platform is provided on an "as available" basis. We do not guarantee continuous, uninterrupted, or error-free operation. Scheduled maintenance, system upgrades, infrastructure issues, or third-party service disruptions may temporarily affect Platform availability.
Force Majeure
Hauser OS Inc. is not liable for any delay or failure to perform resulting from causes outside its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, regulatory changes, public health emergencies, labor disputes, internet or infrastructure outages, or failures of third-party service providers.
Beta Features
From time to time, Hauser OS Inc. may make experimental or pre-release features available to users ("Beta Features"), which may be labeled as "beta," "preview," "experimental," or similar. Beta Features are provided on an "as is" basis and may be incomplete, contain errors, change without notice, or be discontinued at any time. The Platform disclaimers, limitations of liability, and other protective provisions in these Terms apply to Beta Features with full force. We may also limit access to Beta Features to specific users or for specific time periods at our discretion.
13. Termination
By You
You may terminate your Platform account at any time through your account settings or by contacting legal@hauserhq.com. Termination of your Platform account does not affect any obligations under a separately executed Buyer Representation Agreement with Avenida Real Estate Inc.
By Us
We may suspend or terminate your access to the Platform at any time, with or without notice, for violation of these Terms, suspected fraudulent or unlawful activity, non-payment of fees, or any other reason at our reasonable discretion. We will provide notice where practicable.
Data Handling Upon Termination
Upon termination of your account, Hauser OS Inc. will redact personal information — including your name, contact details, and other personally identifying information — from your account and associated records, except where retention is required by law (for example, transaction records subject to California DRE retention requirements).
Anonymized property intelligence data and any derivative works created by Hauser OS Inc. — including scoring outputs, AI-generated analyses, computer vision interpretations, and aggregated insights — remain the property of Hauser OS Inc. and may be retained indefinitely for Platform improvement, research, and operational purposes. Such retained data cannot be used to identify you after redaction.
Documents you uploaded to the Platform ("Uploaded Content") may be deleted upon account termination. You are responsible for downloading or otherwise preserving copies of any Uploaded Content you wish to retain prior to termination.
Folio Transfer
The Platform supports an optional "Folio Transfer" feature that allows current homeowners to transfer their property folio to a new owner upon sale of the property. The folio includes records associated with the property such as inspection reports and disclosures, scoring history, maintenance and service records, repair receipts and invoices, warranty documents, appliance manuals, permit records, and other property-specific documentation accumulated through Platform use.
Folio Transfer is initiated at the discretion of the originating owner and requires the new owner to accept the transfer and agree to these Terms. Personally identifying information of the originating owner is fully redacted from the transferred folio. By initiating a Folio Transfer, the originating owner represents that they have the right to transfer the included content to the new owner.
Hauser does not verify the completeness, accuracy, legality, or transferability of materials included in a Folio Transfer. Before initiating a Folio Transfer, the originating owner is responsible for reviewing the folio and removing any personal, confidential, privileged, financial, or third-party information they do not intend or have the right to share.
Folio Transfer is intended to provide a continuous record of the property’s history — analogous to vehicle service records — to give incoming owners confidence in their new home and visibility into how the property has been maintained over time.
Effect of Termination
Upon termination, your license to use the Platform ceases. The following provisions survive termination: Sections 8 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), 13 (Termination, including data handling), 14 (Dispute Resolution), and 16 (General Provisions), as well as any other provisions that by their nature should survive.
14. Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law provisions.
Informal Resolution
Before initiating formal proceedings, you agree to contact us at legal@hauserhq.com and provide written notice of the dispute. We will attempt to resolve the matter informally within 30 days.
Binding Arbitration
If informal resolution is unsuccessful, disputes shall be resolved by binding arbitration administered by JAMS in San Diego County, California, under JAMS Streamlined Arbitration Rules then in effect. The arbitrator's decision shall be final and binding. Either party may seek emergency injunctive relief in court prior to arbitration to prevent irreparable harm.
Class Action Waiver
You waive any right to participate in a class action lawsuit or class-wide arbitration against Hauser OS Inc. All disputes must be brought in an individual capacity.
30-Day Right to Opt Out of Arbitration
You have the right to opt out of the arbitration provisions of this Section by sending written notice to legal@hauserhq.com within thirty (30) days of first agreeing to these Terms. Your notice must include your name, the email address associated with your account, and an unequivocal statement that you wish to opt out of arbitration. If you opt out, the rest of these Terms remain in effect, and disputes will be resolved in the state or federal courts located in San Diego County, California.
Exceptions
Either party may seek injunctive or other equitable relief in a court of competent jurisdiction for violations of intellectual property rights without first engaging in arbitration or informal dispute resolution.
15. Changes to These Terms
We may update these Terms from time to time. Updates are effective upon posting to hauserhq.com/legal/terms-of-service. We will provide notice of material changes via email to the address associated with your account or via Platform notification at least 14 days before they take effect. Your continued use of the Platform after that period constitutes acceptance of the updated Terms.
Notice
Any notice we are required to provide under these Terms will be sent to the email address associated with your account or posted to the Platform. You are responsible for keeping your contact information current. Notice is deemed given on the date sent or posted, regardless of whether you actually receive or read it.
Notices to Hauser OS Inc. must be sent to legal@hauserhq.com or to the mailing address set forth in Section 17 (Contact).
16. General Provisions
Entire Agreement
These Terms, together with our Privacy Policy and any executed Buyer Representation Agreement, constitute the entire agreement between you and Hauser OS Inc. with respect to the Platform.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of substantially all of our assets.
U.S. Users Only
The Platform is intended for use by residents of the United States. Hauser OS Inc. operates from California and provides services within California (with planned expansion to additional U.S. states). Users accessing the Platform from outside the United States do so at their own risk and are responsible for compliance with applicable local laws.
Accessibility
Hauser OS Inc. is committed to making the Platform accessible. If you encounter accessibility barriers or have feedback on accessibility, please contact us at legal@hauserhq.com so we can work to address the issue.
Account Ownership
Your account is personal to you. You may not transfer, sell, or assign your account to another person, except via the Folio Transfer feature described in Section 13. You have no ownership interest in your account itself; all rights to the account remain with Hauser OS Inc.
